1. Data controller

Juozapavičiaus str. 10A-4, LT-09311, Vilnius (hereinafter – SIT & GO) is responsible for the processing of your personal data collected through www.sitandgo.lt, www.sitandgo.eu, www.sitandgo.lv, www.sitandgo.ee , on car rental points or in other ways in contact with SIT & GO.

2. Legal basis for the processing SIT & GO data

SIT & GO processes data in accordance with Article 6 (1) of the General Data Protection Regulation of the European Union, General Law on Processing, as well as in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania, Latvia and Estonia and the Law on Electronic Communications of the Republic of Lithuania, Latvia and Estonia.

3. Data processed by SIT & GO

3.1. Personal information:

a. Name,

b. Surname,

c. Data on the employment company (as applicable),

d. Date of birth,

e. Telephone number,

f. Email address,

g. Home address.

3.2. Financial data:

a. Payment card details, which are provided for blocking the deposit when picking up the rented vehicle,

b. Payment history, including car rental and all related additional goods, services and taxes.

3.3. Lease agreement details:

a. Driving license data, including but not limited to a copy of the driving license (if it is mandatory)

b. Identity card or passport data

c. Rental vehicle registration number,

d. Rental reservation number,

e. Lease agreement number,

f. Vehicle pick-up and drop-off information: date, time, place,

g. Additional goods, services provided,

h. Financial responsibility for the rented vehicle.

3.4. Third party data:

In the event that the rental vehicle is driven by more than one person and this is noted in the vehicle rental agreement, SIT & GO handles the personal, financial and rental data of the third parties;

3.5. Location of the rented vehicle:

Vehicles leased to SIT & GO may be equipped with GPS trackers to provide SIT & GO with real-time location information for vehicles owned by the company. Information is managed through the website www.tracking.lt

3.6. Other special purpose data:

a. In the event of an accident, SIT & GO may request information of the condition of the driver and / or third parties involved in the accident, i.e. information about alcohol and / or other narcotic and psychotropic substances in the blood, health disorders during the accident,

b. In the event of an accident where the health of the hired vehicle is disrupted during the rental period and he is unable to continue the rental and represent in the incident investigation procedure (serious health, death), SIT & GO handles the financial data of the representative,

c. In the event of damage to the rental vehicle, SIT & GO may process the data necessary to compensate for the cost of the damage to the vehicle, including the course of the events of the damage,

d. In the event of legal proceedings, SIT & GO shall process the data of the driver of the hired vehicle and / or related persons necessary for the resolution of the legal proceedings.

4. Purposes of SIT & GO data processing

4.1. Vehicle rental reservation, rental and further issues related to the rental (general issues, financial history, financial procedures (additional charges, invoicing, etc.) complaints, feedback, traffic violations, theft of the vehicle and / or other criminal offenses, vehicle rental, activities, legal proceedings, etc.). SIT & GO uses the 365ID authentication machine for identity and driving license documents, which scans the document number, dates of issue and validity, the country of issue and automatically records this data. 4.2. Road traffic violations, accidents, vehicle damage. In the event that a road traffic violation has been committed during the vehicle rental period and SIT & GO has received a report of a road traffic violation, SIT & GO will transfer the personal data to the police. In the event of an accident, SIT & GO transfers personal, financial and contractual data to interested third parties in order to resolve the situation and eliminate the losses incurred: police, ambulance, insurance companies, investigative bodies, auditors, debt collection companies, accountants, other entities entitled to personal, financial, contractual and / or other special purpose information. If the competent authorities suspect that an illegal activity has taken place with the hired vehicle, SIT & GO reserves the right to process the additional data transmitted by the competent authority;

4.3. Marketing and advertising. Personal data is processed to inform the user about new products, special offers, loyalty programs, as well as to personalize the site according to individual needs. SIT & GO reserves the right to send a survey for market research, a questionnaire to evaluate the quality of services sent to the e-mail specified in the lease agreement;

4.4. Payments made by third parties. In the event when the driver and payer of the leased vehicle are different entities, SIT & GO handles the data provided by the driver and the payer in relation to the financial statements (invoices, contributions, administrative fines, indemnification, other financial and administrative matters);

4.5. Processing of data in accordance with legal provisions. Personal, financial and contractual data are processed and stored in accordance with SIT & GO’s obligations to the authorities, including but not limited to the submission of personal data to the police in the event of a traffic violations, data retention periods, accounting data retention period, etc.);

5. International data transfer

In the case of a vehicle rental reservation made through a partner’s website in a foreign country, SIT & GO reserves the right to transfer personal data to the partner, including the cases where the partner is from a third country outside the EU,but it is necessary to achieve the objectives set out in this document. If the recipient is not in a country recognized by the European Commission as ensuring an adequate level of data protection, the SIT & GO shall take all possible data protection measures in accordance with the General Data Protection Regulation.

6. Data retention period

SIT & GO shall retain data for the maximum periods required by law, as long as the data must be retained for the purposes of their processing. When personal data is no longer needed, it is destroyed. Exceptions apply to those personal data or specific documents which cannot be destroyed in accordance with the procedure established by legal acts and must be archived.

Storage period:

a. Creating a SIT & GO account and assigning a unique member number – unlimited, as long as the commercial relationship continues;

b. Vehicle lease agreement – 5 calendar years;

c. Payment card details –  maximum for 2 calendar years after the end date of the lease, the period within which SIT & GO can receive a report of a traffic violation from the police and apply an administrative fee in accordance with the company’s terms and conditions. The storage period may be extended with the consent of the user for further reservations;

d. Commercial documents, including accounting documents and records – up to 10 calendar years.

7. Cookies Policy

SIT & GO uses a cookies policy to collect information about the user’s visit to the website www.sitandgo.lt and www.sitandgo.eu. Cookies are used for personalizing the browser’s experience by tailoring the information displayed according to interests and personal needs. The person who browse always has the right to reject cookies or adjust the permission in the settings, but it should be noted that this may lead to limited access to information on the site for the actions he/she takes.

8. Rights of the data subject

In accordance with the General Data Protection Regulation, the data subject has the right to:

a. Obtain information from the controller about the stored data of the data subject: the purposes of the data retention, the categories of personal data, the recipients of the data, the data retention period if that possible. This right also includes the right to ask the controller to rectify personal data, to restrict the processing of personal data relating to the data subject or to object to such processing (BDAR, Art. 15);

b. Require the correction of inaccuracies relating to the data subject. (BDAR, Art. 16);

c. Require the deletion of data relating to the data subject, unless the retention of data in specific circumstances is mandatory simply for the purposes of SIT & GO listed above. Such cases are to be dealt with individually. This right also applies when the data subject withdraws the consent on which the processing is based or the personal data have been processed unlawfully (BDAR, Art. 17);

d. Require restrictions on the processing of personal data if the processing of personal data is illegal, the data subject disputes the accuracy of the data and the data controller must verify the data (BDAR, Art. 18);

e. To disagree with processing of the data subject’s data for direct marketing purposes and to withdraw his consent at any time. Upon written request for withdrawal of consent from the data subject, SIT & GO undertakes to immediately terminate the processing of the data subject’s data for marketing purposes (BDAR, Art. 21);

f. To submit a complaint against the processing his or her personal data with the supervisory authority if he or she considers that the processing of his or her personal data infringes the said Regulation. (BDAR, 77 p.).
